1. Terms of Use
By accessing and using the Timely platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized access to or use of your username, password, or any other breach of security. You also agree to ensure that you exit from your account at the end of each session when accessing Timely. You should use particular caution when accessing your account from a public or shared computer.
3. Acceptable Use
You agree not to misuse the Timely services or help anyone else do so. For example, you must not attempt to:
- Access or tamper with non-public areas of the platform
- Probe, scan, or test the vulnerability of any system or network
- Breach or circumvent any security or authentication measures
- Access, search, or create accounts for the Services by any means other than our publicly supported interfaces
- Interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing
- Use our services to distribute malware, spyware, or other malicious code
- Impersonate or misrepresent your affiliation with any person or entity
4. Content, Data Usage and Intellectual Property
Our service allows you to store, share, and otherwise make available certain information, text, graphics, or other material. You retain any and all of your rights to any content you submit, post, or display and you are responsible for protecting those rights.
You represent and warrant that you own or have the necessary rights to use and authorize Timely to use all intellectual property rights in and to any content that you submit. You agree that this content will not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.
4.1 Data Usage Commitment
Timely is committed to transparent and ethical data practices. We pledge the following:
- No Data Selling: We will never sell, rent, or trade your personal data to third parties for any monetary or other consideration. Your data is yours.
- Third-Party Login Protection: Information obtained through third-party login services (such as Google Sign-In) is only used for authentication and to provide you with our services.
- Calendar/Service Integrations: When you authorize us to access your calendar or other services (like Google Calendar), that data is only used to provide you with the relevant features within Timely.
- No Secondary Use: Data you provide us is only used for the purposes you expect - to deliver and improve our service to you. It is not used for unrelated marketing or advertising purposes.
5. Termination
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the services will immediately cease. If you wish to terminate your account, you may simply discontinue using the services, or you may contact us to request account deletion.
6. Limitation of Liability
In no event shall Timely, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
